4. Facts of the violation and reasons: Oceanic Beverages Co., Inc. has received a letter from Hsu Shun Foods Corp on November 20, 2020. In this letter, Hsu Shun Foods Corp requested Oceanic Beverages Co., Inc. to perform the agreement on reconciliation binding the two companies dated January 1, 1999, which involved the entitlement of the Trademark “Apple Cider” of Oceanic Beverages and whether production and sale could be furthered in the future with the same brand. However, Oceanic Beverages did not publish the aforementioned material information at MOPS (Market Observation Post System) until December 10, 2020, which is a violation of Subparagraph 2, Paragraph 3 under Article 36 of the Securities and Exchange Act.
5. The disciplinary action: A fine of NT$240,000 was imposed on the responsible person for the conduct pursuant to Subparagraph 4, Paragraph 1, Article 178, and Article 179 of the Securities and Exchange Act.
